NYC proposes ban on large sodas at restaurants

(AP) ? Want to super-size that soda? Sorry, but in New York City you could be out of luck.

In his latest effort to fight obesity in this era of Big Gulps and triple bacon cheeseburgers, Mayor Michael Bloomberg is proposing an unprecedented ban on large servings of soda and other sugary drinks at restaurants, delis, sports arenas and movie theaters.

Drinks would be limited to 16 ounces, which is considered a small serving at many fast-food joints.

"The percentage of the population that is obese is skyrocketing," Bloomberg said Thursday on MSNBC. He added: "We've got to do something."

It is the first time an American city has directly attempted to limit soda portion sizes, and the soft-drink industry and others bitterly accused the three-term mayor of creating a "nanny state" and robbing New Yorkers of the right to decide for themselves.

"The people of New York City are much smarter than the New York City Health Department believes," Coca-Cola Co. said in a statement. "New Yorkers expect and deserve better than this. They can make their own choices about the beverages they purchase."

The ban is expected to win approval from the Bloomberg-appointed Board of Health and take effect as soon as March. City officials said they believe it will ultimately prove popular and push governments around the U.S. to adopt similar rules.

The ban would apply only to sweetened drinks over 16 ounces that contain more than 25 calories per 8 ounces. (A 12-ounce can of Coke has about 140 calories. Plastic bottles of Coke and other soft drinks often contain 20 ounces.)

It wouldn't affect diet soda, any drink that's at least 70 percent juice, or one that is at least half milk or milk substitute. Nor would it apply to drinks sold in many supermarkets or convenience stores. Businesses would face fines of $200 per failed inspection.

City officials said some calorie-heavy drinks such as Starbucks Frappuccinos would probably be exempted because of their dairy content, while Slurpees and Big Gulp drinks at 7-Eleven wouldn't be affected because the convenience stores are regulated as groceries.

Bloomberg said people who want to guzzle soda would still be free to order more than one drink. But he said restricting servings to 16 ounces each could help curb consumption.

"You tend to eat all of the food in the container. If it's bigger, you eat more. If somebody put a smaller glass or plate or bowl in front of you, you would eat less," the mayor said.

In announcing the proposal, health officials cited research linking sugary drinks to rising rates of obesity, diabetes and heart disease. At the same time, City Health Commissioner Thomas Farley said the city has no intention of reducing portion sizes of solid foods.

"Sugar drinks are not the entire obesity epidemic, but they are uniquely, strongly associated with this rise in obesity over the last 30 years," Farley said. "There's something about sugar water, as a product, which leads to long-term weight gain."

The commissioner estimated that obesity-related illnesses in New York City cost $4 billion a year.

Kelly Brownell, director of the Rudd Center for Food Policy and Obesity at Yale University, said he believes the ban would be effective.

"Soft drinks are the single greatest source of added sugar in the American diet," said Brownell, who has campaigned for a soda tax to cut consumption.

Stefan Friedman, spokesman for the New York City Beverage Association, argued the ban would do little to reduce New Yorkers' waistlines, pointing to federal data showing that calories from sugary drinks are a declining portion of American diets even as obesity increases.

At a Burger King in Manhattan, retired postal worker Bobby Brown didn't like the mayor's idea, saying people should be "free to choose what they drink or eat."

But Joseph Alan, a chauffeur eating at a nearby Subway, said his overweight friends' eating habits ultimately affect him, too: "I tell them, 'This is affecting our insurance, because charges go up more treating people with diabetes and other health problems. I don't want to pay more for health insurance so people have these drinks!'"

Under Bloomberg, New York has campaigned aggressively against obesity, outlawing trans fats in french fries and other restaurant food and forcing chain restaurants to list calories on menus. The mayor has also led efforts to ban smoking in the city's bars, restaurants, parks and beaches.

His administration has tried other ways to discourage soda consumption. The mayor supported a state tax on sodas, but the measure died in the Legislature, and he tried to restrict the use of food stamps to buy soda, an idea federal regulators rejected.

Legal experts said the soft drink industry may mount a challenge to the new rule by arguing that it's arbitrary or internally inconsistent.

Given that you can't buy a 32-ounce serving but you can buy two 16-ounce ones, "a court might say that all it does is help the cup industry by making people buy more cups," said John Humbach, a professor at Pace Law School. But he called that approach "a long shot."

(Bloomberg isn't against all sugary treats. He recently issued a proclamation declaring Friday as NYC Donut Day, honoring an annual tradition launched 75 years ago to honor women who served the treats to soldiers. City Hall officials emphasized the proclamation doesn't represent Health Department policy.)

Mark Kalinowski, an analyst with Janney Capital Markets who covers companies such as McDonald's, predicted an uproar.

"Folks who want to buy Big Gulps and Frappuccinos, a lot of those customers, you're only going to be able to take it away from them by prying it out of their cold, dead hands," he said.

If the ban goes into effect, he said, customers will probably just respond by ordering two drinks.

"Maybe the mayor can outlaw all soft drinks and outlaw all fun while he's at it," Kalinowski scoffed.

Military leaders have long known that marching in unison makes for a tight-knit platoon. Past research by psychologist Scott Wiltermuth of the University of Southern California Marshall School of Business suggests that this cooperation emerges when the group members? emotions are aligned. Now he finds such synchrony can also encourage aggression, according to a study published in January in the Journal of Experimental Social Psychology.

Wiltermuth and his colleagues assigned subjects to groups. The researchers gave each group a set of cups and taught them a choreographed cup-moving routine that they would perform later to music. To create an atmosphere of competition, the researchers tasked them with memorizing a list of cities?they would be tested later, and the highest-scoring groups could win $50. Then all participants put on headphones and performed the cup routine in time to the music they heard. In some groups, participants ended up moving the cups in sync with one another; in other groups, each subject heard music with varying beats and could not coordinate with other participants. After completing the cup activity, the researchers told each group they could select the music a different group would hear during its cup-moving routine. One of the options was a loud, aggravating blast of static. Teams that had moved in sync were more likely to choose the noxious noise than those that had been out of sync. A more tightly knit team, it seems, is a fiercer foe.

In a companion study, to be published in Social Influence, Wiltermuth found that members of an in-sync group were also more destructive. The groups were given live pill bugs and told to shoo them into boxes described as ?exter?minators? (in reality, the boxes held the bugs unharmed). When prompted by a leader, those that had moved in sync earlier drove 54 percent more insects into the extermination boxes than did out-of-sync control subjects.

Wiltermuth explains that these findings underscore the importance of questioning our actions and those of our leaders. ?We are doing things we wouldn?t otherwise do, because we feel an emotional connection to our team,? he says.

Facebook has its eyes on Face.com, reports say

There's nothing like an acquisition to?distract investors?from your falling stock price.?

Reports in the tech press Tuesday said that Facebook, whose stock is still reeling from the aftershocks of a bungled IPO, is looking to acquire Israel-based face recognition technology company Face.com for around $80 million to $100 million.

The Los Angeles Times reported that rumors of the deal for the startup surfaced in the Israeli press and then were quickly picked up by tech reporters. Several of the reports said that when they contacted Face.com CEO Gil Hirsch, he responded by saying he had no news to share.

Shares of Facebook (FB) were down about 7 percent on Tuesday to just below $30 on a day when most market indices were higher. It was the first time since Facebook's debut on May 18?that its shares dipped below $30,?putting the shares about?21 percent below the IPO price of?$38 a share.?It was also the first time that Facebook?options began trading.?

Sandy Rosenthal: The Start of Hurricane Season and Quick Drive-by Levee Inspections

On the first day of Hurricane Season, June 1, a certain unease creeps into the city of New Orleans.

Residents begin checking the weather forecasts for low depression spots, the harbingers of monster storms. And they start thinking about levees partly because shortly after the devastating flood during Katrina, the New Orleans Times Picayune reported that annual levee inspections in Orleans Parish tended to be quick drive-by affairs ending with lunch for 40-60 people costing the state as much as $900.

While this is true, the same reports went on to suggest that the quickie inspections might have contributed to the catastrophic flooding and that the local Orleans Levee Board (OLB) may be partly responsible. Neither suggestion was ultimately proved true, but the myths persist.

Here is what really happened.

Pre-Katrina, the Army Corps of Engineers was required to administer annual levee inspections of completed federal flood protection levees in Orleans Parish.

ER 1130-2-530, 30 Oct 96 establishes the policy for the operation and maintenance (O&M) of USACE flood control and related structures at civil works water resource projects and of USACE-built flood protection projects operated and maintained by non-Federal sponsors.

This program, called the Inspections of Completed Works by the federal sponsor (Corps) was designed to insure that the local sponsor (Orleans Levee Board) was complying with its federally mandated levee maintenance.

Before the 2005 flood, the OLB's maintenance activity included mainly cutting the grass on levee embankments and removing unwanted vegetation and debris. But, the OLB also performed other activities like checking concrete surfaces for open cracks, and inspecting for ruts, depressions and erosion on earthen levees.

To be clear, responsibility for the annual inspections belonged solely to the Army Corps. It would obviously be a conflict of interest for the OLB to inspect its own work. The Army Corps's inspections should perhaps be thought of as independent annual quality audits of the OLB's year-round maintenance activity.

Additionally, the Corps of Engineers' annual inspections were not designed to verify structural stability and performance and thus, could not have been expected to uncover potential problems with levees' and flood walls' ability to function. In other words, they were not a factor in the flooding as concluded by the preeminent report for information relating to the 2005 flood - the Decision-Making Chronology Report of 2008.

The drive-by levee inspections are therefore, a red herring in the story about the New Orleans flood.

To our knowledge, the Army Corps of Engineers has not directly supported the myth of the levee inspections. The myth apparently took wings on its own, months before the major levee investigations were completed; and in a post-flood environment of anger, grief and a rush to pass judgement.

After the levee failure investigations all concurred that design and construction flaws, not mother nature, was responsible for the flood, Congress responded by passing the first ever country-wide levee safety legislation which may affect the 55% of the nation's population protected by levees. The legislation ordered national policy changes in levee safety and levee building.

And even though annual levee maintenance inspections were irrelevant in the New Orleans Flood, the Army Corps also overhauled its annual inspections protocols nationwide. Now using global positioning and other modern technology, the Army Corps' annual inspections of completed works are more formal, more uniform and pay greater attention to all components of the levee system.

In the meantime, those annual lunches, which were intended as a social occasion for Army Corps personnel to meet staffers from the Orleans Levee Board, are a thing of the past.

Barrie, Belleville, Newmarket and Hamilton are the First - With a renewed commitment to customer service and dramatic changes to store layout and merchandising, big things are happening at Sears.

On May 25th, Sears Canada unveils its new, refreshed store concept in four Ontario locations: Barrie, Belleville, Newmarket and at the Lime Ridge mall in Hamilton. These stores reflect the Company's plans to transform the Sears shopping experience in Canada.

Changes in the stores include: wider aisles, less clutter and streamlined merchandise offerings with exciting new brands at everyday low prices. In all the stores, expanded sections include: KidsRoom and BabyRoom, Jessica women's suit shops, Men's suit shops with easier by-size shopping and additional fitting services, a new assortment and look for Craftsman outdoor power equipment and a market-leading assortment of major appliances and mattresses.

In Newmarket, the new store has an improved check-out process. In Barrie and Belleville, easy-access shopping carts will now be available.

In addition, Trend Directors Cynthia Florek (Womenswear) and Nancy Dennis (Menswear and Kidswear) will be on hand in two of the stores on the 26thto present special style-savvy seminars. Cynthia and Nancy will be in Newmarket at 11am and in Barrie at 2pm.
"Our goal with the refreshed stores is to create a stage for product in an authoritative way to make it easier for our customers to shop for the items they expect from Sears and to demonstrate our leadership in the marketplace," said Calvin McDonald, President and CEO, Sears Canada. APPLICANTS for jobs with the Australian Defence Force are being asked if they are gay or if they're good at sex as part of psychological testing.

Other questions include if candidates are cheating on their partners, if they are addicted to pornography or if they've ever made a sex tape.

A candidate told this week of being offended by an "extremely personal" line of questioning during the test.

Another employee at the ADF confirmed being asked sexually orientated questions during recruitment.

The potential recruits were told the questions were necessary to ensure they had no secrets that could be used if someone tried to blackmail them in the future for sensitive information.

Defence Minister Stephen Smith said yesterday the sexually explicit questions served "no useful purpose" and were "not within the testing parameters".

A Defence Force spokesman said the psychological tests were outsourced to a "workforce solutions" company called ManpowerGroup.

"Release of test items and interview questions asked of applicants undergoing the ADF selection process into the public domain would potentially undermine the process," the spokesman said.

"Making such knowledge public would allow candidates to develop and rehearse their responses to better manage the impression they give in the assessments."

ManpowerGroup declined to elaborate on the questions they put to candidates.

BLACK HEALTH CARE COALITION HOSTS FREE RUN/WALK JUNE 2 TO INCREASE AWARENESS FOR THE IMPORTANCE OF ACTIVE AND FIT FAMILIES

KANSAS CITY,?Mo.?? The Black Health Care Coalition (BHCC) invites Greater Kansas City area residents to participate in the upcoming?Let?s?Move?5K Run/Walk. The walk will be held in conjunction with the annual Public Health and Safety Fair presented by Missouri State Sen. Shalonn ?Kiki? Curls. The free community events aim to demonstrate the importance of exercise for better health and obesity prevention.

Insight: Iran's "Great Game" in Afghanistan

KABUL (Reuters) - With most foreign combat troops set to withdraw from Afghanistan by 2014, Iran is using the media in the war-ravaged nation to gain influence, a worrying issue for Washington.

Nearly a third of Afghanistan's media is backed by Iran, either financially or through providing content, Afghan officials and media groups say.

"What Iran wants, what they are striving at, is a power base in Afghanistan that can counter American influence," said a senior government official, who like others for this report, spoke to Reuters on condition of anonymity.

"They are without a doubt doing this through supporting and funding our media."

Iran spends $100 million a year in Afghanistan, much of it on the media, civil society projects and religious schools, says Daud Moradian, a former foreign ministry advisor who now teaches at the American University in Kabul.

"It is using Afghanistan to send a message to America that it can't be messed with. Afghanistan becomes a managed battlefield as a result."

Officials in Tehran could not be reached for comment despite repeated attempts and the Iranian embassy in Kabul said it was not prepared to talk about the issues raised in this report.

NEW STRATEGIC PACT

The landmark agreement NATO leaders sealed this week in Chicago, handing control of Afghanistan over to its own security forces by the middle of next year, puts the Western alliance on an "irreversible" path out of the unpopular, decade-long war.

Some security analysts say the withdrawal could lead to increasing instability and then to civil war -- and an opportunity for Iran and others to move into the resulting power vacuum.

When the Soviet Union withdrew from Afghanistan in 1989 following a decade-long occupation and the pro-Moscow government in Kabul collapsed, Afghanistan's neighbors moved in to arm and fund proxies to gain regional influence as the country plunged into civil war.

Although Kabul's ties with Tehran have seen sporadic improvement after the 2001 ouster of the Taliban, which had emerged triumphant after the civil war, the relationship is combustible.

The latest flashpoint is the recent signing of a long-term strategic agreement between the United States and Afghanistan. Though vague on details, the pact was meant to signal U.S. financial and security commitments to Afghanistan through 2024 - particularly for funding the large Afghan National Army.

Iran, whose frayed ties with the United States have worsened over its disputed nuclear programme, sees the pact as a threat. Iranian-backed media in Afghanistan responded by churning out reports critical of the agreement, and Tehran's ambassador to Afghanistan Abu Fazel Zohrawand threatened to expel Iran's one million Afghan refugees if the pact was not rejected.

IRAN'S TALKING HEADS

Afghanistan's intelligence department, the National Directorate of Security (NDS), had earlier gone public with Iran's alleged meddling in the media, saying that weekly newspaper Ensaf and TV channels Tamadon and Noor had received financial support from Iran.

A journalist who recently left Tamadon TV, owned by Afghanistan's most prominent Shi'ite cleric Ayatollah Mohammed Asef Mohseni, told Reuters that while the station never confirmed it was getting support from Tehran "it was obvious".

"My salary of $600 a month would fluctuate dramatically, as it was pegged to Iran's rial," said the 23-year-old, one of 200 employees at Tamadon, where he worked for four years before resigning over fears his employment would land him in trouble with Afghan authorities.

"Our office is full of posters calling for protests against the strategic pact with America. We'd invite pro-Iran analysts onto our shows saying Iran was the only one who could help Afghanistan with food and supplies," said the recent graduate, dressed in a tight black long-sleeved t-shirt and jeans.

Tamadon TV dismissed the claims of Iranian backing as an "insult". Editor in chief Mohammad Rahmati said the station was targeted "because we show core Islamic values; we don't show half-naked dancing women".

GREAT GAME

Afghanistan has been so much a focus of big power rivalry over the past 200 years -- a failed British occupation in the mid-19th century, the failed Russian one in the 1980s, for example -- it has its own historical sobriquet, "The Great Game".

As the United States prepares for its own dispirited withdrawal from Afghanistan, it is worried about Iran gaining a strategic advantage in Afghanistan, after seeing Tehran win influence in Iraq following the 2003 U.S. invasion.

More than half of the 171 TV, satellite channels and radio stations licensed to broadcast in Iraq today are funded by Iran, with others backed by the United States and Arabic Gulf countries, government communications officials say.

Iran's media strategy is but one strand in a multi-pronged projection of "soft power" into Afghanistan. The two countries share cultural, language and historical links -- for centuries they were part of the ancient Persian empire -- as well as a long and porous border.

Iran said in 2010 it has provided some $500 million in official assistance for reconstruction projects. Tehran has built religious schools for Afghan Shi'ites, who comprise a fifth of Sunni-majority Afghanistan's 30 million people.

Iran may even have MPs on its payroll. An Afghan official who declined to be identified told Reuters that up to 44 of the 249 members of the Afghan parliament are suspected of receiving money from Iran. Iran has not responded to those allegations, which have also been aired in the Afghan media.

SHI'ITE LINKS

Iran's vehement opposition to the new strategic pact with the United States appears to have intensified efforts to influence public opinion about it.

Ensaf newspaper, one of the three media outlets the government has said receives funding from Iran, and whose parent company Avapress has offices in Tehran, has published six critical articles on the pact since it was signed by President Barack Obama on a whistle-stop visit to Kabul on May 2.

The three media outlets feature news reports that hold little interest for Afghans, but are important to Iran, using the same messages and wordage carried by Iranian state media.

The state of Israel, for instance, is called "the Zionist regime", a term Afghan officials generally avoid using.

"The fact is the stories broadcast have been made available by Iranian sources for propaganda purposes", Loftullah Mashal, a spokesman for the intelligence agency NDS, said last month. The NDS later retracted that claim.

Iran first started attempting to influence Afghan affairs through the media in 2006, said Abdul Mujeeb Khalvatgar, executive director of the Afghan media development group Nai.

"The pace has been quickening since 2011, which is when Iran began to actually inject its viewpoint into Afghan media," he said.

Last year, Afghans were shocked when Tamadon TV broadcast a live speech by Iran's parliament speaker Ali Larijani criticizing the presence of Western troops in Afghanistan.

Kabul is countering with its own pressure.

The Kabul-based reporter of Iran's semi-official Fars News Agency, Abdul Hakimi, was arrested two weeks ago on charges of spying, Afghan officials said. The NDS declined to comment.

The relatively large, often Western-backed press corps can also face intimidation, abduction or even death for reporting on issues such as corruption and other government failings. Afghanistan ranks seventh on the Committee to Protect Journalists' "Impunity Index", a listing of countries where journalists are killed regularly and governments fail to solve the crimes.

One man who says he is painfully familiar with Iranian interference is author and journalist Razaq Mamoon. He says a masked man who threw acid in his face in January of last year was working for Tehran. The Iranian embassy in Kabul has not commented on his allegations.

Though media reports at the time said his assailant staged the attack over a soured love affair, Mamoon says his 2010 book which accuses Iran of sabotage and espionage in Afghanistan, motivated Iranian intelligence agencies to attack him.

"Those individuals who planned the attack on me are still in power and their Iranian spy agencies are still very active in Kabul," Mamoon, who now lives in New Delhi out of fear for his safety, told Reuters in e-mailed comments.

Flaming Lips Take Aim At Jay-Z's Record At O Music Awards

Band will attempt to break Hov's record for most live concerts in 24 hours at the O Music Awards, set for June 27.

The O Music Awards are back once again. And this time, they're taking the bus ... all day long.

Yes, on June 27, the digitally driven event will let someone else take the wheel as they play out aboard a tricked-out tour bus that will travel through the Mississippi Delta, the birthplace of rock and roll. The trek — from Memphis to New Orleans — will take place over 24 hours, making the O Music Awards the world's first 24-hour awards-show live stream.

Of course, that's not the only first that'll take place during the show. In keeping with tradition, the O Music Awards will also see another attempt at a Guinness World Record as the Flaming Lips ride along aboard the bus as the de facto house band and aim to break Jay-Z's record for the most live concerts in 24 hours by playing gigs in eight different cities.

"I don't remember if I was asked or if I volunteered. ... But I've accepted the job of not driving but commandeering the Magical Mystery Merry Prankster bus," Lips frontman Wayne Coyne said. "I've accepted the attempt at breaking the world record of performing eight shows in 24 hours. And I've explained to the music freaks at MTV, VH1 and CMT that I am not a host. ... But I always liked the way Jerry Lewis would get all sweaty toward the end of his yearly telethon. To play and sing Flaming Lips songs at eight in the morning, well ... I'm open to new experiences."
