Dear Paul and Walter,

I wanted to follow up briefly on Paul's posting about McComish, the Arizona public financing case, and Walter's post on GPS surveillance. Because I can't help but notice that once again this term ends with a big ideology-defying rupture on the court over questions of technology and the Constitution. I am fascinated by the ways in which new technology is always being used, evaluated, and also shunned by the court as needed.

Start with a footnote: In Chief Justice John Roberts' discussion over whether the Arizona "clean elections" law at issue in McComish was an effort to "level the playing field" or "combat corruption," he deploys technology in a way that's worth contemplating. Noting that the court has "repeatedly rejected the argument that the government has a compelling state interest in "leveling the playing field" that permit undue burdens on political speech," the chief justice then busts the state of Arizona for tweaking its website after oral argument. As Richard Hasen was quick to notice, Roberts points out in a footnote: "Prior to oral argument in this case, the Citizens Clean Elections Commission's Web site stated that 'The Citizens Clean Elections Act was passed by the people of Arizona in 1998 to level the playing field when it comes to running for office.' The Web site now says that 'The Citizens Clean Elections Act was passed by the people of Arizona in 1998 to restore citizen participation and confidence in our political system.'" I'm not sure if that's the first time a Supreme Court justice has called out a party for altering their website after oral argument, but it sure goes to show how much fun a jurist can have with a sharp-eyed clerk and a reliable Internet connection.

Then there's Justice Samuel Alito, concurring in the violent video games case this morning, who reveals himself to be incredibly savvy about the rapidly evolving technology of violent games. He writes: "Today's most advanced video games create realistic alternative worlds in which millions of players immerse themselves for hours on end. These games feature visual imagery and sounds that are strikingly realistic, and in the near future video-game graphics may be virtually indistinguishable from actual video footage. Many of the games already on the market can produce high definition images, and it is predicted that it will not be long before video-game images will be seen in three dimensions. It is also forecast that video games will soon provide sensory feedback." Alito notes that the day is coming in which "virtual reality shoot-'em-ups" will allow children to "'actually feel the splatting blood from the blown-off head'" of a victim." And he concludes that because new technologies present new possibilities for different kinds of harm to minors, he believes that "The Court acts prematurely in dismissing this possibility out of hand." Here is Alito fully immersing himself in new technologies and also warning the court that it's too early to understand where those technologies are headed.

Justice Antonin Scalia pokes fun at Alito's extra-credit dabbling, writing that he "has done considerable independent research to identify video games in which "the violence is astounding," but he sees no point to any of it. In Scalia's view, the technology is irrelevant, and the same arguments being leveled at video games were once leveled at comic books. Just because technology is morphing doesn't mean the First Amendment ought to. Which brings us to Justice Stephen Breyer's dissent in the same case, citing many, many studies showing that "virtual violence in video game playing results in those neural patterns that are considered characteristic for aggressive cognition and behavior." But?again proving that new technology is also his friend?Breyer also offers the first citation in Supreme Court history, according to the keen eyes of Josh Blackman, to a YouTube video.

Between Doe v. Reed, the Phelps case, and today's opinions, it's clear to me that Breyer, Alito, and Thomas have become the court's strongest proponents of the idea that new technology is so radically different (mostly in bad ways) that First Amendment rules need to be revisited. It's completely fascinating to watch them deploy new technologies to prove that very point. Breyer is often the first to admit that courts don't always understand new things (although Roberts said the same this past weekend), but it's hard not to look at the ways these justices both talk about and use evolving technologies as proof that?as Homer Simpson once said of alcohol?it is both the cause of, and solution to, all of our problems.

Kahakai Kitchen: Fusilli in Saffron-Chive "Cream" Sauce with ...

Where did the month of June go?!? I swear I just announced I was hosting Food 'n Flix this month and now I am sneaking in just a few days before the deadline with my dish inspired by the foodie chick-flick, No Reservations. A sweet little movie about Kate, a workaholic perfectionist chef whose life is turned upside down when her sister dies and Kate takes custody of her young niece, Zoe. Add to the mix, sexy, relaxed Nick, brought in under Kate's protests to handle the kitchen of the restaurant, and Kate's world spins out of the careful control she keeps it in.

In coming up with a dish, I wanted to throw a little of each character into whatever I came up with. Kate is known for her saffron cream sauce--Nick even begs her for the recipe. Zoe doesn't eat (Kate's fancy, restaurant dishes are a bit too much for her), until Nick tempts her with fresh basil and makes a bowl of simple spaghetti. So... in honor Kate, Zoe and Nick, we have a bowl of Fusilli in Saffron-Chive Sauce with Pistachio-Basil Pesto. Slightly sophisticated but still approachable and I think Zoe would like the curly fusilli noodles.

I wanted a healthier version of a saffron cream sauce and have had the recipe for Saffron-Chive Sauce in "Conscious Cuisine: A New Style of Cooking From the Kitchens of Chef Cary Neff," tagged to make for a while now. Instead of cream and butter, this vegan sauce uses a surprise ingredient--potatoes to thicken it. (Cool huh?!) I wanted something to compliment and enhance the creamy yellow saffron sauce so I came up with a simple garlicky, basil pesto with pistachio nuts.

Chef Cary Neff says, "Saffron is made from the stigmas of a beautiful purple crocus found in Spain and the Middle East. Each flower has only three stigmas, and each stigma is hand-picked, which makes saffron very expensive. Its pungent smell, bitter flavor, and yellow color have been used throughout the ages in magic, medicine, and cooking. This recipe creates all of the pleasures of a wonderful saffron cream sauce without the use of cream or butter. Pureed potatoes thicken the sauce and provide a creamy mouth feel. The flavor is as good as its counterpart without the extra calories and fat--Conscious Cuisine at its best!"

Saffron-Chive Sauce
From "Conscious Cuisine" by Cary Neff
(Makes 2 1/2 Cups)

1/2 tsp extra-virgin olive oil
1 cup diced yellow onion (about 1 large)
1 tsp minced garlic
1 Tbsp saffron threads
1 cup white wine
3 cups vegetable stock
1 cup diced, peeled potatoes (about 2 medium)
1/2 tsp sea salt
1/8 tsp freshly ground black pepper
2 Tbsp chopped fresh chives.

Heat a medium saucepan over medium-high heat and add the olive oil to lightly coat the bottom of the pan. Stir in the onion, garlic, and saffron and cook until the onion has softened and the saffron has released its color, about 2 minutes. Pour in the wine and cook until reduced and the pan is almost dry, about 3 to 5 minutes, to concentrate the flavors of the sauce. Add the stock and potatoes and bring to a boil. Reduce heat and simmer until the potatoes are soft, about 15 minutes.

Carefully ladle the potato mixture into a blender and process until smooth. Strain the blended mixture through a colander lined with cheesecloth or a fine mesh strainer. Pour the strained sauce back into the sauce pan and bring to a low boil. Adjust the seasonings with salt and pepper. Stir in the chives.

Use the sauce immediately of cool quickly by setting in a bowl of ice and water. Store in an airtight container for up to 1 week in the refrigerator or freeze for about 1 month.

Nutritional Info: Per 1/4 cup: Calories: 45, Protein: 1g, Total Fat: 0g, Saturated Fat: 0g, Carbohydrates: 7g, Dietary Fiber: 1g, Cholesterol: 0mg, Sodium: 40mg

Pistachio-Basil Pesto
by Deb, Kahakai Kitchen
(Makes about 1 1/2 cups)

3/4 cup pistachios, shelled
2 packed cups fresh basil leaves
3 gloves garlic, chopped
juice of one lemon
1/4 cup olive oil (plus more to blend if needed)
salt and black pepper to taste

Blend all ingredients in a food processor, adding additional olive oil as needed to get it to the desired consistency.

Notes/Results: Excellent! The saffron sauce was thick and creamy--although it is hard to see that in the pictures as it coated the pasta so well. The pesto brightened up the flavor of the dish and added a satisfying nuttiness to it. I was a little worried that the saffron would be too bitter and overpowering in the sauce but it was actually fairly mild and lightly sweet. This is a healthy vegan dish that tastes decadent and I like the bright colors of the sauce and pesto. I would make it again.

I've been thinking about those matters a lot in the past. The string fields have to be constrained by the "p.w = N-N~" constraint (which is unusual from a strictly field-theoretical viewpoint) and there are other issues but you may gain many advantages.

My adviser, Tom Banks, would always dislike my attempted "double field theory" viewpoint - for reasons that I understood well but couldn't share with their full negative emotions. It's like making "p" and "x" of the phase space both "commutative". Except that even the latter thing may be usefully defined - if products of operators are written as star-products etc.

The frustrating thing is that among the 20 lectures at Strings 2011 so far (3 days out of 5), Chris Hull's lecture was unusual because it was the only one about the actual physics of string theory.

Other lecturers are - or were - string theorists but their talks are not really string theory and they shouldn't represent a majority of a strings conference. While those lectures are about fair technical work in field theory and mathematics - non-gravitational supersymmetric theories; field theories in lower dimensions found as limits of strings; topological string theories etc.; effective field theory approaches to quantum cosmology - their goal is not to understand string theory itself, the whole beast. So they're not really not that conceptually deep.

This terrible percentage of string talks will be partially repaired during the last two days. Thursday will be dedicated to AdS/CFT-like issues; Friday will hopefully see some flux compactifications and Calabi-Yau geometry, cosmology, and Erik Verlinde's entropic pseudoscience for which he should have been stripped of his physics PhD (he has already denounced dark energy, dark matter, inflation, and even the big bang itself) - but instead, he has received about 10 million dollars from the Dutch government.

At any rate, it is frustrating to see this collapse of the activity dedicated to string theory itself. The probability that something really important and conceptually new beyond the SM will be found without string theory is comparable to the probability that an extraterrestrial alien will land here and give us their newest comprehensive textbook of high-energy physics.

So the loss of activity - and dwindling attempts - is nothing else than the loss of ambitions and it might turn out to be pretty hard for someone to convince me that the ultimate main driver of this downtrend is something else than the desire of many string theorists to sooth their inferior, non-stringy colleagues and not-so-colleagues.

MRI Fear Resolved With EFT

Many people hate enclosed spaces and avoid elevators, walk-in closets and MRI scans. There is something about having to get an MRI that triggers claustrophobia in a large segment of the population. This is a real problem for nurses and technicians who struggle with frantic patients. Emotional Freedom Technique, EFT, is an energy healing tool that can help patients have a positive MRI experience.

In December 2010, ?Magnolia? a spunky seventy year old woman in great health scheduled a session to work on a specific fear: she had been having migraines and her doctor suggested an MRI to rule out a brain tumor. She was terrified of being inside the machine and having to lie very still.

She said she didn?t like to be in tight, closed spaces and didn?t want to do it!

We had been working together for some time with EFT, Emotional Freedom Techniques, and we had already worked on her fear of illness and of brain cancer. We worked through a childhood episode of accidentally being locked up in a closet for two hours; we also worked on her fear of heights and on a spider phobia. This session was specific to the claustrophobia and anxiety she felt about having an MRI scan.

Interestingly enough, as soon as I asked her to imagine herself inside the MRI machine, she couldn?t do it. We tapped on her fear of having to do the test; she wanted to be ready and relaxed for the scan and was having a hard time ?imagining being in that situation.?

I retrieved a big cardboard box from the garage, put a pillow for her head inside it and invited her to get into the box. As soon as she was lying down inside the box she was flooded with emotions and sensations! Magnolia was very agitated and was sure ?they? would not let her have a pillow and be comfortable.

We tapped for her anxiety; she described it as ?pressure? in her chest. When we brought the intensity down for that, she noticed she felt nausea. We tapped on the nausea and it disappeared. Now she felt tightness in her head. We tapped on that and it disappeared. She couldn?t close her eyes because she was going to suffocate; in a couple of rounds that was gone.

In EFT we call these shifting symptoms ?Chasing the Pain.? As we deal with a physical manifestation, in my experience, we are actually addressing and taking care of the emotional issue behind it.Other sensations and feelings that came up for her were: itching, shallow breathing and generalized anxiety. We tapped for each one of them. She needed a pillow under her legs, and believed ?they? won?t want me to be comfortable. Usually the technicians do want you to be comfortable, it makes their work easier. We worked with that belief until she was confident that she was comfortable and could be so during the actual scan. I suggested she try sleeping, and we worked on her belief that she ?could never fall asleep in that box.?

After 40 minutes of working, Magnolia closed her eyes, breathed deep and said, ?It?s just a box; they?re just going to take pictures!? We then worked on the sounds she would be hearing. She tapped as she listened to a recording of MRI sounds. She doesn?t have an iPod or MP3 player that she could take to the scan, but she does have earplugs.

At the end of our session, she was almost asleep inside the box! Of course, that was just a box and it was in my office, but she now felt confident that the scan would go well. Two weeks later Magnolia called to tell me that she had had her scan and she had been very relaxed and had fallen asleep! Oh, and everything was clear!
